І. GENERAL PROVISIONS
- 1.1. Starokostyantynivska Secondary School of Grades I-III No. 1 of the Starokostyantynivska City Council of the Khmelnytskyi Region is in the communal property of the Starokostyantynivska City Council.
- 1.2. Legal address of the educational institution: 40 Ostrozkogo st., Starokostyantyniv, Khmelnytskyi Region, 31100, tel. 3-30-04, 3-20-52, sk-school1@i.ua, was established on November 7, 1965.
- 1.3. Starokostyantynivska Secondary School of Grades I-III No. 1 of the Starokostyantynivska City Council of the Khmelnytskyi Region is a legal entity, has an independent balance sheet, an account in a bank, a seal, a stamp, and an identification number.
- 1.4. The founder of the educational institution is the executive committee of the Starokostyantynivska City Council.
- 1.5. The main goal of the educational institution is to ensure the realization of the right of citizens to receive complete general secondary education, to create conditions for the full implementation of Article 3 of the Law of Ukraine "On Education":
- ensuring the right of citizens to free education regardless of gender, race, nationality, social and property status, type and nature of occupation, ideological beliefs, party affiliation, attitude to religion, creed, state of health, place of residence and other circumstances;
- ensuring the development of the educational institution, strengthening its educational and material base;
- implementation of social protection of employees and students, creation of conditions for their education, training and work in accordance with the standards of material, technical and financial support;
- organization of registration of preschool and school-age children, control of compliance with the requirements for children's education in an educational institution;
- resolving, in accordance with the established procedure, issues related to the guardianship and care of minors left without parents, orphans, protection of their rights, provision of material and other assistance.
- 1.6. The main task of the educational institution is:
- ensuring the realization of the right of citizens to complete general secondary education;
- education of a citizen of Ukraine;
- fostering a respectful attitude towards the family, respect for folk traditions and customs, native language, national values of the Ukrainian people and other peoples and nations;
- formation and development of a socially mature, creative personality with a conscious civic position, a sense of national identity, a personality prepared for professional self-determination;
- fostering in students respect for the Constitution of Ukraine, state symbols of Ukraine, human and citizen rights and freedoms, a sense of self-esteem, responsibility before the law for one's actions, and a conscious attitude towards the duties of a person and citizen;
- development of the student's personality, his abilities and talents, scientific worldview;
- implementation of students' right to freely form political and ideological beliefs;
- fostering a conscious attitude towards one's own health and the health of other citizens as the highest social value, forming the foundations of a healthy lifestyle, preserving and strengthening the physical and mental health of students;
- creating conditions for mastering the system of scientific knowledge about nature, man and society based on:
- scientific and secular nature of education;
- integration of education with science and production;
- flexibility and predictability of the education system;
- unity and continuity of the education system.
- 1.7. The educational institution in its activities is guided by the Constitution of Ukraine, the Laws of Ukraine "On Education", "On General Secondary Education", the Regulation on a General Educational Institution, approved by the Resolution of the Cabinet of Ministers of Ukraine dated August 27, 2010 No. 778, the State Program "Teacher", the National Doctrine of Education Development, other regulatory legal acts, and its own charter.
- 1.8. The educational institution independently makes decisions and carries out activities within the limits of its competence, as provided for by the legislation of Ukraine and its own charter.
- 1.9. The educational institution is responsible to the individual, society and the state for:
- safe conditions for educational activities;
- compliance with state education standards;
- compliance with contractual obligations with other entities of educational, industrial, and scientific activity, including obligations under international agreements;
- maintaining financial discipline.
- 1.10. The educational institution has established Ukrainian as the language of instruction, and in-depth study of subjects has been introduced: foreign language, Ukrainian language, biology, mathematics, computer science, and specialized training for high school students.
- 1.11. The educational institution has the right:
- to pass state certification in accordance with the established procedure;
- to determine the forms, methods and means of organizing the educational process in agreement with the owner;
- to determine the variable component of the working curriculum;
- to develop and implement experimental and individual working curricula in accordance with the established procedure;
- together with higher educational institutions, research institutes and centers, to conduct research, experimental, search work, and to work on pre-university training courses that do not contradict the legislation of Ukraine;
- to use various forms of moral and material encouragement for participants in the educational process;
- to receive funds and material values from executive authorities, legal entities and individuals;
- to retain and use its own revenues in accordance with the procedure established by the legislation of Ukraine;
- to develop its own social base: a network of sports and recreation, medical and preventive and cultural units;
- to independently develop and approve the annual plan, regulations of the educational institution, class schedule and other internal regulations documents;
- to choose forms, means and methods of teaching, upbringing, teaching aids and textbooks, that meet the requirements of Articles 16 and 17 of the Law "On General Secondary Education";
- to attract additional financial sources, including foreign currency, through the provision of paid services, voluntary donations and targeted contributions from individuals and legal entities, including foreign ones;
- to rent and lease property in compliance with the requirements of the articles of the law "On Local Self-Government";
- to establish direct contacts with institutions and organizations in compliance with the requirements of Article 64 of the Law "On Education" and Article 2 of the Law "On General Secondary Education";
- to assist parents and relatives in creating conditions for children to receive secondary (complete) education in the form of family upbringing and external education;
- to provide home lessons with students in accordance with medical reports and in accordance with the Regulations on individual forms of education in general education institutions.
- 1.12. The following methodological associations of class teachers, teachers of primary grades, Ukrainian language and literature, mathematics, English, biology and chemistry, history and geography, labor training and fine arts, physical education and the subject "Defense of the Fatherland", a methodological council, a school of young teachers, a school of advanced pedagogical experience, creative and dynamic groups, and a psychological lecture hall are created and function in the educational institution.
- 1.13. Medical care for students and appropriate conditions for its organization are provided by the founder and carried out by the Starokostyantynivska District Hospital, its children's consultation and adolescent office. The educational institution provides premises and ensures the necessary conditions for the work of medical personnel, fulfills the requirements of the Laws of Ukraine "Fundamentals of Legislation on Health Care" (Articles 31, 59-66, 80) and "On the Protection of Childhood".
- 1.14. The relationship of an educational institution with legal entities and individuals is determined by agreements concluded between them.
ІІ. ORGANIZATION OF THE EDUCATIONAL PROCESS
2.1. The educational process at the institution is carried out in accordance with working curricula, compiled on the basis of standard curricula approved by the Ministry of Education and Science.
The institution's working curriculum specifies the variable part of the state education standards in accordance with the training profile.
The institution works according to curricula, textbooks, and manuals that have the appropriate Ministry of Education and Science seal, and ensures the fulfillment of educational tasks at each level of education in accordance with the age characteristics and natural abilities of children.
Individualization and differentiation of learning in the institution is ensured through the implementation of the invariant and variable parts.
2.2. Working curricula are approved by the Education Department of the Executive Committee of the City Council.
Experimental and individual working curricula of the institution are agreed with the Ministry of Education and Science upon submission of the education department of the regional state administration.
- 2.3. The institution ensures that the level of general secondary education meets state educational standards, and that teaching and upbringing are unified.
- 2.4. The institution selects forms, means and methods of teaching and upbringing in accordance with the Laws of Ukraine "On Education", "On General Secondary Education" and its charter, taking into account the specifics of the institution, its profile and other features of the organization of the educational process.
- 2.5. The educational institution carries out the educational process in group and individual forms of training.
2.6. Enrollment of students in an educational institution is carried out before the beginning of the academic year by order of the principal.
To enroll a student in an institution, parents or persons replacing them submit an application, a copy of the child's birth certificate, a medical certificate of the established form, a personal file (except for children entering the first grade), and for a third-level educational institution - a document confirming the appropriate level of education.
Children are usually enrolled in the first grade from the age of 6.
Transferring students to the next grade is carried out in accordance with the procedure established by the Ministry of Education and Science.
In the event of a student leaving the locality, parents or persons replacing them submit an application to the institution indicating the reason for leaving.
In the event that a student transfers to another educational institution to receive general secondary education within the city, parents or persons replacing them submit an application to the institution indicating the reason for the transfer and a certificate confirming the fact of the child's enrollment in another educational institution.
2.7. The institution may implement educational programs and provide paid services on a contractual basis according to the list approved by the Cabinet of Ministers of Ukraine.
The procedure for providing paid services is approved by the Ministry of Education and Science in consultation with the Ministry of Finance and the Ministry of Economy.
2.8. The structure of the academic year (duration of classes, division into semesters) and the work schedule are established by the educational institution within the time frame provided for in the working curriculum, in agreement with the education department of the executive committee of the city council.
The academic year at the institution begins on September 1 and ends no later than July 1 of the following year.
- 2.9. The total duration of vacations during the academic year should not be less than 30 calendar days.
2.10. The duration of lessons at the institution is 35 minutes in 1st grade, 40 minutes in 2nd-4th grade, and 45 minutes in 5th-11th grade.
Changing the duration of lessons is allowed upon approval by the education department of the executive committee of the city council and the state sanitary and epidemiological service.
2.11. For students in grades 5-9, it is allowed to hold two lessons in a row during laboratory and test work, writing essays, and labor training lessons.
In grades 10-11, it is allowed to hold two consecutive lessons in one subject of the invariant and variable parts of the curriculum and specialized disciplines (subjects).
2.12. Distracting students from classes to engage in other activities is prohibited (except for cases provided for by the legislation of Ukraine).
Involving students in activities not provided for by the educational program and working curriculum of the institution is permitted only with their consent and the consent of their parents or persons replacing them.
- 2.13. The institution may choose other forms of organizing the educational process besides the lesson.
2.14. In primary school, extended-day groups are created for students in grades 1-4 at the request and at the expense of their parents or persons replacing them, provided that there is an appropriate educational and material base, teaching staff, and service personnel.
Enrollment in and expulsion from extended-day groups is carried out by order of the director of the educational institution based on the application of the parents (persons replacing them).
The following operating mode for extended day groups is determined:
- 13.15 – 13.30 – reception of children;
- 13.30 – 14.00 – dinner;
- 14.00 – 14.30 – educational work;
- 14.30 – 15.30 – walk in the fresh air;
- 15.30 – 16.30 – self-study (grades 2-4), intellectual recreation (grades 1);
- 16.30 – 17.00 – leisure;
- 17.00 – 17.15 – self-service, classroom cleaning.
- 2.15. The duration of breaks between lessons is set taking into account the need to organize active recreation and nutrition for students, but not less than 10 minutes, long breaks after the 3rd and 4th lessons - 20 minutes.
- 2.16. The lesson schedule is drawn up in accordance with the working curriculum of the institution in compliance with pedagogical and sanitary and hygienic requirements and is approved by the head of the institution.
- 2.17. In addition to various forms of mandatory educational classes, the educational institution conducts individual, group, optional and other extracurricular classes and activities, which are provided for by a separate schedule and are aimed at satisfying the educational interests of students and developing their creative abilities, inclinations and talents.
2.18. The content, scope, and nature of homework assignments for each subject are determined by the teacher in accordance with pedagogical and sanitary and hygienic requirements, taking into account the requirements of the curriculum and the individual characteristics of students.
Homework is not given to first grade students.
- 2.19. The criteria for evaluating students' academic achievements are determined by the Ministry of Education and Science.
2.20. Students' academic achievements during the school year are recorded in class journals, the instructions for which are approved by the Ministry of Education and Science. The results of educational activities for the year are entered into students' personal files.
In the first grade, a verbal description of the knowledge, skills and abilities of students is given. By decision of the pedagogical council of the educational institution, a verbal description of the knowledge, skills and abilities of students in the second grade may be given.
In subsequent grades, assessment is carried out in accordance with the criteria for assessing students' academic achievements.
- 2.21. Education in the final (4th, 9th and 11th) grades of the institution is completed by a state final certification. The content, form and procedure of the state final certification are determined by the Ministry of Education and Science. In some cases, students may be exempted from the state final certification due to health conditions or other valid reasons in accordance with the procedure established by the Ministry of Education and Science and the Ministry of Health.
- 2.22. Based on the results of the study, students (graduates) are issued a corresponding document (report card, certificate of basic general secondary education, certificate of complete general secondary education), which reflects the students' achievements in their studies for the semesters, academic year, teaching practice and state final certification. The results of the semester and annual assessment are brought to the attention of students by the class teacher (head of the certification committee).
- 2.23. The procedure for transferring and graduating students from an educational institution is determined by the Instructions on the Transfer and Graduation of Students from Educational Institutions of General Secondary Education of All Types and Forms of Ownership, approved by the Ministry of Education and Science of Ukraine.
- 2.24. When transferring students from primary to secondary school, first of all, academic achievements not lower than the average level in the Ukrainian language, reading, and mathematics are taken into account.
- 2.25. Monitoring the compliance of the educational level of students who have completed a certain level of education with the requirements of the State Standard of General Secondary Education is carried out through their state final certification.
- 2.26. Students who have completed a certain level of education are issued a corresponding education document:
- after graduating from primary school – report card;
- after graduating from primary school - certificate of basic general secondary education;
- upon graduation from an educational institution – a certificate of complete secondary education.
- 2.27. For excellent academic achievements, students in grades 2-8, 10 can be awarded a letter of commendation "For high academic achievements", and graduates of the 3rd level school - a letter of commendation "For special achievements in studying individual subjects", medals - gold "For high academic achievements" or silver "For academic achievements". For excellent academic achievements, graduates of the 2nd level institution are issued a certificate of basic general secondary education with honors.
- 2.28. The education of students at the institution is carried out during lessons, in the process of extracurricular and extracurricular work.
2.29. The establishment and operation of organizational structures of political parties, as well as religious organizations and paramilitary formations, is prohibited in the institution.
Forcibly involving students of the institution in joining any associations of citizens, public, socio-political, religious organizations and paramilitary formations, as well as in activities in the specified organizations, participation in campaign work and political actions is prohibited.
2.30. Discipline in the institution is maintained on the basis of mutual respect among all participants in the educational process, compliance with the internal regulations and the charter of the educational institution.
The use of physical and mental violence against students is prohibited.
ІІІ. PARTICIPANTS OF THE EDUCATIONAL PROCESS
- 3.1. Participants in the educational process in a general education institution are:
- the pupils;
- the executives;
- the pedagogical workers;
- the psychologists, the librarians;
- other specialists;
- the parents or persons replacing them.
- 3.2. The status, rights and obligations of participants in the educational process, their rights and obligations are determined by the Laws of Ukraine "On Education", "On General Secondary Education", other legislative acts, these Regulations, the charter, and the rules of the institution's internal regulations.
- 3.3. A student is a person who studies and is educated in an institution.
- 3.4. Students of the institution have the right, guaranteed by the state:
- for accessibility and free complete general secondary education;
- to choice of form of study, profile direction, electives, special courses, extracurricular activities;
- for safe and harmless learning and working conditions;
- to use of the educational, production, scientific, material and technical, cultural and sports, correctional and rehabilitation and medical and health-improving facilities of the institution;
- for participation in various types of educational, scientific and practical activities, conferences, Olympiads, exhibitions, competitions, etc.;
- for receiving additional, including paid, educational services;
- for review of the results of the assessment of academic achievements in all subjects of the invariant and variable part;
- for participation in the work of the institution's public self-government bodies;
- for participation in the work of voluntary amateur associations, creative studios, clubs, circles, interest groups, etc.;
- to respect for human dignity, free expression of views and beliefs;
- for protection from any forms of exploitation, mental and physical violence, from actions of teaching and other employees that violate their rights, humiliate their honor and dignity.
- 3.5. Students of the institution are obliged to:
- master knowledge, skills, and practical abilities in an amount no less than that specified by the State Standard of General Secondary Education;
- improve your general cultural level;
- participate in research and scientific activities provided for by the educational programs and curriculum of the institution, its charter;
- comply with legal requirements, moral and ethical norms, respect the honor and dignity of other students and employees;
- fulfill the requirements of teaching and other employees of the institution in accordance with the charter and internal regulations of the institution;
- participate in various types of work activities;
- treat state, public and personal property, as well as the property of other participants in the educational process, with care;
- comply with the requirements of the charter and internal regulations of the institution;
- follow the rules of personal hygiene.
- 3.6. Pupils are prohibited from:
- bring, transfer and use weapons, alcoholic beverages, toxic and narcotic substances;
- use any means and substances that may cause explosions and fires;
- use physical force to clarify relationships, intimidate and extort;
- carry out any actions that entail dangerous consequences for others.
- 3.7. For failure by participants in the educational process to fulfill their duties, violation of the charter, internal regulations, penalties may be imposed on them in accordance with the law.
- 3.8. A teaching employee must be a person with high moral qualities, who has an appropriate pedagogical education, an appropriate level of professional training, ensures the effectiveness and quality of his work, and whose physical and mental health allows him to perform professional duties in educational institutions of the general secondary education system.
- 3.9. Persons who are prohibited from teaching in institutions due to medical indications or a court ruling are not allowed to do so. The list of medical contraindications to teaching is established by law.
3.10. Appointment to a position, dismissal from a position of pedagogical and other employees of the institution, other labor relations are regulated by labor legislation, the Law of Ukraine "On General Secondary Education" and other legislative acts.
The volume of teachers' pedagogical workload is determined in accordance with the legislation by the head of the institution and approved by the education department of the executive committee of the city council.
The volume of the pedagogical workload may be less than the tariff rate (official salary) only with the written consent of the pedagogical employee.
Redistribution of teaching workload during the academic year is permitted only in the event of a change in the number of hours for studying individual subjects, as provided for by the working curriculum, or with the written consent of the teaching staff in compliance with the requirements of labor legislation.
- 3.11. The head of the institution appoints class teachers who manage classrooms and workshops, whose rights and responsibilities are determined by the regulatory legal acts of the Ministry of Education and Science, internal regulations, and the charter of the institution.
3.12. Distraction of teaching staff from the performance of professional duties is not allowed, except in cases provided for by law.
The involvement of teaching staff in types of work not provided for by the working curriculum, curricula and other documents regulating the activities of the educational institution is carried out only with their consent.
3.13. The teaching staff of the institution are subject to certification in accordance with the procedure established by the Ministry of Education and Science.
Based on the results of the certification of teaching staff, their suitability for the position is determined, a qualification category is assigned (specialist, specialist of the second, first, highest category) and the pedagogical title "senior teacher", "teacher-methodologist", "teacher-organizer-methodologist" and others may be assigned.
- 3.14. The teaching staff of the institution have the right:
- to independently choose forms, methods, and ways of educational work that are not harmful to students' health;
- to participate in the work of methodological associations, meetings, assemblies of the institution and other self-governing bodies of the institution, in events related to the organization of educational work;
- to choose forms and improve their qualifications;
- to study at higher educational institutions and institutions of the system of training and advanced training of pedagogical workers;
- to undergo certification to obtain the appropriate qualification category and receive it in case of successful completion of the certification;
- to conduct scientific research, experimental, and exploratory work in accordance with the established procedure;
- to make proposals to the management of the institution and education authorities on improving educational work;
- for social and material security in accordance with the legislation;
- to join trade unions and be members of other associations of citizens whose activities are not prohibited by law;
- to raise issues of protection of rights, professional and human honor and dignity.
- 3.15. The teaching staff of the institution are obliged to:
- ensure the proper level of teaching of academic disciplines in accordance with the curricula in compliance with the requirements of the State Standard of General Secondary Education;
- monitor the level of students' academic achievements;
- be responsible for ensuring that the assessment of students' academic achievements complies with the assessment criteria approved by the Ministry of Education and Science, and bring the results of students' academic achievements to the attention of children, parents, persons replacing them, and the head of the educational institution;
- promote the development of children's interests, inclinations and abilities, as well as to preserve their health;
- cultivate respect for state symbols and the principles of universal morality;
- comply with the institution's charter, internal regulations, and the terms of the employment contract;
- participate in the work of the pedagogical council;
- cultivate in students a respectful attitude towards parents, women, and older people; respect for folk traditions and customs, spiritual and cultural heritage of the people;
- prepare students for independent life while adhering to the principles of mutual understanding and harmony between all peoples, ethnic, national, and religious groups;
- adhere to pedagogical ethics, morality, respect the personal dignity of students and their parents;
- constantly improve their professional level, pedagogical skills, and level of general culture;
- carry out orders and instructions of the head of the educational institution, education management bodies;
- maintain appropriate documentation.
- 3.16. Teaching staff who systematically violate the charter, internal regulations of the institution, do not fulfill their official duties, the terms of the employment agreement (contract), or do not correspond to the position held according to the results of the certification, are dismissed from work in accordance with the law.
- 3.17. The rights and obligations of other employees and support staff are regulated by labor legislation, the charter, and the internal rules of the institution.
- 3.18. Parents of students and persons replacing them have the right to:
- choose forms of education and upbringing of children;
- create parent public organizations and participate in their activities, to elect and be elected to parent committees and public self-government bodies;
- contact education authorities, the head of the institution and public self-government bodies on issues of education and upbringing of children;
- make decisions about the child's participation in the scientific, sports, labor, research and innovation activities of the institution;
- participate in activities aimed at improving the organization of the educational process and strengthening the material and technical base of the institution;
- protect the legitimate interests of children in the public self-government bodies of the institution and relevant state and judicial bodies.
- 3.19. Parents and persons replacing them are responsible for their children's acquisition of complete general secondary education, their upbringing and are obliged to:
- create conditions for a child to receive a complete general secondary education in any form of education;
- ensure that children comply with the requirements of the institution's charter;
- respect the honor and dignity of the child and the institution's staff;
- constantly take care of the physical health and mental state of children, create appropriate conditions for the development of their natural abilities;
- cultivate hard work, a sense of kindness, mercy, and a respectful attitude towards the Fatherland, family, state and native languages;
- respect for the national history, culture, and values of other peoples;
- educate children in respect for laws, rights, and fundamental human freedoms.
- 3.20. In the event that parents and persons replacing them fail to fulfill their obligations under the law, the institution may initiate, in accordance with the established procedure, a petition for the liability of such persons, including the deprivation of their parental rights.
IV. EDUCATIONAL INSTITUTION MANAGEMENT
- 4.1. The institution is managed by its director. The head of the institution may be a citizen of Ukraine who has a higher pedagogical education at the specialist or master's level, has at least three years of teaching experience, and has successfully passed the certification of management personnel of educational institutions in accordance with the procedure established by the Ministry of Education and Science.
- 4.2. The head of the educational institution and his deputies are appointed to and dismissed from office by the Department of Education of the Executive Committee of the City Council in accordance with the legislation.
- 4.3. Head of the institution:
- manages the teaching staff, ensures rational selection and placement of personnel, creates the necessary conditions for improving the professional and qualification level of employees;
- organizes the educational process;
- provides control over the implementation of curricula and programs, the quality of students' knowledge, skills and abilities;
- is responsible for compliance with the requirements of the State Standard of General Secondary Education, for the quality and efficiency of the work of the teaching staff;
- creates the necessary conditions for students to participate in extracurricular and extracurricular activities, and conduct educational work;
- ensures compliance with requirements for child protection, sanitary and hygienic and fire safety standards, and safety requirements;
- disposes of the institution's property and funds in accordance with the established procedure;
- supports initiatives to improve the system of education and upbringing, encourage creative searches, and research and experimental work of teachers;
- promotes the involvement of scientists, cultural figures, members of creative unions, employees of enterprises, institutions, and organizations in the educational process, and the leadership of student associations based on interests;
- ensures the implementation of students' right to protection from any forms of physical or mental violence;
- takes measures to prevent students from using alcohol and drugs;
- supervises the organization of nutrition and medical care for students;
- issues orders and instructions within its competence and monitors their implementation;
- reports annually on its work at the general meeting (conference) of the team.
- 4.4. The head of the institution is the chairman of the pedagogical council - a permanent collegial governing body of the institution.
- 4.5. Meetings of the pedagogical council are held as needed, but at least four times a year.
- 4.6. The pedagogical council is considering the issue of:
- improvement and methodological support of the educational process;
- planning and operating hours of the institution;
- variable component of the working curriculum;
- transferring students to the next grade and graduating them, issuing documents about the appropriate level of education, rewarding them for academic success;
- improving the qualifications of teaching staff, developing their creative initiative, introducing scientific achievements and advanced pedagogical experience into the educational process;
- participation in the institution's innovative and experimental activities, cooperation with higher education institutions and scientific institutions;
- moral and material encouragement of students and employees of the institution;
- moral encouragement of parents and persons replacing them, and public figures who participate in the organization of the educational process;
- holding students and employees of the institution accountable for failure to fulfill their duties;
- the pedagogical council also considers other issues related to the activities of the institution..
4.7. The body of public self-government of the institution is the general meeting (conference) of its staff, which is convened at least once a year.
The procedure for convening, powers, number, and composition of the general meeting (conference) of the collective are determined by the charter of the institution and the collective agreement.
The general meeting (conference) hears the director's report on the implementation of the institution's management, considers issues of the educational, methodological, economic, and financial activities of the institution.
4.8. In an institution, by decision of the general meeting (conference), an institution council may be created and operate, the activities of which are regulated by its charter, as well as children's and youth interest groups, a school-wide parent committee, methodological associations, commissions, and associations, the regulations for which are developed and approved by the Ministry of Education and Science.
Representatives of the teaching staff, students of the 2nd and 3rd grade, parents, and the public are elected to the school council.
V. MATERIAL AND TECHNICAL BASE AND FINANCIAL AND ECONOMIC ACTIVITIES
- 5.1. The material and technical base of the institution includes buildings, structures, land, communications, equipment, and other material assets, the value of which is reflected in the balance sheet.
- 5.2. Property assigned to an educational institution belongs to the institution on the basis of operational management and cannot be withdrawn from it, unless otherwise provided for by law.
- 5.3. The institution is financed by its founder (owner) or a body authorized by him in accordance with the legislation.
- 5.4. The financial and economic activities of the institution are carried out in accordance with the Budget Code of Ukraine, the Laws of Ukraine "On Education", "On General Secondary Education" and other regulatory legal acts.
- 5.5. The sources of funding for the institution are:
- local budget funds in the amount provided for by the standards for financing general secondary education to ensure the educational process in the amount determined by the State Standard for General Secondary Education;
- funds received for the provision of paid services;
- income from leasing premises, structures, equipment;
- charitable contributions from legal entities and individuals;
- other sources not prohibited by law.
- 5.6. The procedure for record-keeping and accounting in the institution is determined by legislation, regulatory legal acts of the Ministry of Education and Science and other central executive bodies, under whose jurisdiction the institution belongs. Accounting is carried out independently or through the centralized accounting department of the education department of the executive committee of the city council.
- 5.7. The institution has the right, in accordance with the legislation, to purchase and lease the necessary equipment and other material resources, use the services of enterprises, institutions, organizations and individuals, and finance from its own funds measures that contribute to the improvement of the educational and material base of the institution.
- 5.8. Reporting on the institution's activities is carried out in accordance with the legislation.
VI. INTERNATIONAL COOPERATION
6.1. The institution, provided it has an adequate material, technical, socio-cultural base, and appropriate funding, has the right to conduct international student and pedagogical exchange within the framework of educational programs and projects, and to establish direct ties with international organizations and educational associations in accordance with the law.
The institution has the right, in accordance with the legislation, to conclude cooperation agreements with educational institutions, scientific institutions, enterprises, organizations, and public associations of other countries.
- 6.2. The institution's participation in international programs, projects, student and pedagogical exchange is carried out in accordance with the legislation.
VII. CONTROL OVER THE ACTIVITIES OF THE EDUCATIONAL INSTITUTION
- 7.1. State control over the activities of an educational institution is carried out in order to ensure the implementation of a unified state policy in the field of general secondary education.
- 7.2. State control over the activities of the institution is carried out by the Ministry of Education and Science, other central executive bodies to which the institution belongs, the State Inspectorate of Educational Institutions under the Ministry of Education and Science, local executive bodies, local self-government bodies, and the Education Department of the Executive Committee of the City Council.
- 7.3. The main form of state control over the activities of an educational institution is state certification of the institution, which is carried out at least once every ten years in accordance with the procedure established by the Ministry of Education and Science.
- 7.4. Extraordinary certification is carried out, as an exception, only by decision of the Ministry of Education and Science upon submission of the public self-government body of the institution or the education department of the executive committee of the city council.
- 7.5. A certified institution that provides training at the level of basic or complete general secondary education is confirmed to have the right to issue state-standard education documents.
- 7.6. In the period between certification, inspections (inspections) of the institution are carried out on issues related to educational activities. The content, types and frequency of such inspections are determined depending on the state of educational work, but not more often than twice a year. Inspections on issues not related to the educational work of the institution are carried out by its founder (owner) in accordance with the legislation.
VІІІ. REORGANIZATION OR LIQUIDATION OF AN EDUCATIONAL INSTITUTION
8.1. The decision to reorganize or liquidate an educational institution is made by the founder.
Reorganization of an educational institution occurs through merger, acquisition, division, or separation.
Liquidation is carried out by a liquidation commission appointed by the founder, and in cases of liquidation by decision of a commercial court - by a liquidation commission appointed by this body.
From the moment the liquidation commission is appointed, it assumes the authority to manage the educational institution.
- 8.2. In the event of reorganization, the rights and obligations of the educational institution are transferred to the successors in accordance with current legislation or specific educational institutions.
ІХ. FINAL PROVISIONS
- 9.1. Starokostyantynivska Secondary School of Grades I-III No. 1 of the Starokostyantynivska City Council of the Khmelnytskyi Region operates and adheres to the Laws of Ukraine and other regulatory legal acts that cover the scope of its activities.
- 9.2. This Statute is valid within the framework of the rights of officials and their compliance with the Laws of Ukraine.
- 9.3. Starokostyantynivska Secondary School of Grades I-III No. 1 of the Starokostyantynivska City Council of the Khmelnytskyi Region has the right to its own standards that do not contradict current legislation, and has the right to its own ceremonial (traditions).
- 9.4. Along with the School Charter, separate documents that do not contradict it are in force:
- Internal regulations;
- Regulations on the school council.
