The Ministry of Education and Science approved the Procedure for responding to cases of bullying (harassment).
The document defines the mechanism for responding to cases of bullying (harassment) in educational institutions of all types and forms of ownership, except for those that provide adult education, including postgraduate education.
Who and how should respond to cases of bullying and apply measures of educational influence in educational institutions.
Bullying (harassment) in educational institutions includes cases that take place directly in the premises of the educational institution and in the adjacent territories (including educational premises, premises for sports, events, corridors, changing rooms, restrooms, shower rooms, canteen, etc.) and ( or) outside the educational institution during activities provided for by the educational program, work plan of the educational institution, and other educational activities organized with the consent of the head of the educational institution, including on the way to (from) the educational institution.
Signs of bullying (harassment) are systematic actions by the participants of the educational process in relation to a minor or minor person and (or) such a person in relation to other participants in the educational process, including using electronic means of communication, namely:
- deliberate deprivation of food, clothing, funds, documents, other property or the opportunity to use them, obstruction in obtaining educational services, forced to work and other offenses of an economic nature;
- verbal insults, threats, including against third parties, humiliation, harassment, intimidation, other actions aimed at restricting a person's expression of will;
- any form of unwanted verbal, non-verbal or physical behavior of a sexual nature, including derogatory looks, gestures, offensive body movements, nicknames, insults, jokes, threats, spreading offensive rumours;
- any form of unwanted physical behavior, including slapping, kicking, pushing, pinching, whipping, biting, hitting;
- other offenses of a violent nature.
Subjects of response in the event of bullying (harassment) in educational institutions are:
- educational ombudsman service;
- services for children;
- centers of social services for families, children and youth;
- local self-government bodies;
- heads and other employees of educational institutions;
- the founder of educational institutions or a body authorized by him;
- territorial bodies (units) of the National Police of Ukraine.
Subjects responding to cases of bullying (harassment) in educational institutions act within the limits of the powers stipulated by the law.
